TERMS AND CONDITIONS

Effective Date: August 21, 2025 Welcome to Gakku.ai website, applications, and other services (collectively, "Services") provided by Algorithm of Learning Inc. (hereinafter referred to as “Company,” “Gakku.ai,” “we,” or “us”). These Terms of Service (“TOS”) govern your access to and use of the Services. Please read them carefully before using the Services. By registering, accessing, or using the Services, you agree to be bound by these TOS. If you do not agree, do not use the services.
1. Acceptance of Terms
1.1 By registering, accessing, or using the Services, you accept and agree to these TOS.
1.2 We may modify these TOS at any time. Modifications become effective upon posting with an updated “Effective Date.” Continued use of the Services after such modifications constitutes acceptance of the updated TOS.
2. Registration and Account
2.1 Users must register an account to access the Services. Registration is free and open to all ages. No parental consent is required for minors.
2.2 You must provide accurate and complete information during registration and promptly update it if it changes.
2.3 Users may log in from multiple devices. You are responsible for all activity under your account. If you suspect unauthorized access, notify us immediately.
2.4 Users may optionally link third-party accounts (e.g., Google).
3. Gems
3.1 Gems are the virtual currency used to access Services such as AI Writing Workshop and AI Math Coach. Gems may be used for additional features in the future.
3.2 All Gems, whether purchased, promotional, or free, are valid for three (3) months from the date of issuance or purchase. Any unused Gems will automatically expire at the end of this period.
3.3 Gems are non-refundable and cannot be transferred between users.
3.4 Gems usage rules:
- AI Writing Workshop: 80 Gems per session.
- AI Math Coach: 1 Gem per generated explanation; failed or incomplete generations do not consume Gems.
4. Payments
4.1 Gems can be purchased using credit/debit cards, PayPal, Google Pay, or other supported payment methods.
4.2 Payments are processed immediately and are non-refundable.
4.3 Prices may change at any time; only the displayed price at the time of purchase applies.
5. Use of Services
5.1 Users may redeem Gems to access AI Writing Workshop and AI Math Coach sessions.
5.2 Users may upload personal content (e.g., PDFs, writing prompts). Users are responsible for the legality and accuracy of uploaded content.
5.3 Generated content from AI services is owned by the Company unless explicitly stated otherwise.
6. Content Restrictions
6.1 Users may not submit content that:
- Violates applicable law;
- Contains offensive, abusive, discriminatory, threatening, obscene, or otherwise inappropriate material;
- Infringes third-party intellectual property rights;
- Contains malware, viruses, or other harmful code.
6.2 The Company may remove content violating these rules. Users remain responsible for their content.
7. Intellectual Property
7.1 All Services, content, and technology are owned by the Company or its licensors and protected by copyright, trademark, and other intellectual property laws.
7.2 Users are granted no rights to the intellectual property of the Services except as expressly permitted by these TOS.
8. Liability
8.1 The Services are provided “as-is” and without warranties of any kind, whether express or implied.
8.2 The Company is not liable for damages resulting from the use or inability to use the Services.
8.3 Users are solely responsible for their accounts, content, and activity.
9. Third-Party Services
9.1 Services may link to or include third-party services. The Company is not responsible for third-party content, accuracy, legality, or quality.
9.2 Users must comply with third-party terms when using linked services.
10. Minors
10.1 Users of any age may register. No parental consent is required.
10.2 Parents or guardians are responsible for their minor children’s use of the Services and compliance with these TOS.
11. Governing Law, Arbitration, and Class Action Waiver
11.1 These TOS are governed by the laws of the United States.
11.2 Arbitration: Any dispute, claim, or controversy arising out of or relating to these TOS or the Services shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA) in a location convenient to the Company, unless otherwise agreed.
11.3 Class Action Waiver: You and the Company agree that all disputes will be resolved individually. You waive the right to participate in class actions, collective actions, or representative actions. An arbitrator shall have no authority to hear or arbitrate any class, collective, or representative claim.
11.4 If the class action waiver is deemed unenforceable, the enforceable portion of the waiver will be applied, and any remaining dispute must be litigated individually in a court of competent jurisdiction.
12. Force Majeure
The Company is not liable for delays or failures in performance resulting from causes beyond its reasonable control, including natural disasters, technical failures, or governmental actions.
13. Severability
If any provision of these TOS is found invalid or unenforceable, the remaining provisions remain in full effect.
